Categories of Personal Data and Voluntary Nature of Providing Data

As the organizer of the E-commerce Germany Awards (the "Contest"), the Company collects personal data from individuals acting on behalf of Participants when submitting applications on the Contest website. This includes:

  • Email address
  • First name and last name
  • Represented brand name
  • Phone number
  • Website address

During Stage II of the Contest, which involves public voting, we process voters' email addresses. Voting is open to individuals with active LinkedIn profiles. Providing personal data is voluntary. However, without it, participation in the Contest or voting will not be possible.

Purpose of Data Processing

The personal data listed above is processed for the following purposes:

  1. Organizing and managing the Contest.
  2. Verifying that voters are real individuals.
  3. Conducting direct marketing for the Administrator's services, including email communications about the current and future editions of the Contest and the E-Commerce Berlin Expo & Conference.

Legal Basis for Data Processing

  1. Contest Participation: Data processed for organizing the Contest and verifying voters (Purposes 1 and 2) is based on Article 6(1)(b) of the GDPR (necessary for the performance of a contract). The agreement's terms are outlined in the Contest's Terms and Conditions.
  2. Marketing Activities: Data used for marketing purposes (Purpose 3) is based on Article 6(1)(f) of the GDPR (legitimate interest of the Administrator). Our legitimate interest includes promoting the Contest and encouraging participation in current and future editions via email.

Data Retention Period

Personal data collected for Contest participation will be stored until the conclusion of the current Contest edition. Data processed for marketing purposes will be retained until the individual objects to its processing.

Data Storage

All data is securely stored on servers provided by Hetzner Online GmbH (Industriestr. 25, 91710 Gunzenhausen, Germany). Additional details can be found here.

Rights of Data Subjects

Individuals whose personal data is processed have the following rights:

  1. Access: You can request confirmation of whether your personal data is being processed and access the information provided in this document.
  2. Correction: You may request corrections to any inaccurate or incomplete personal data.
  3. Erasure ("Right to be Forgotten"): You can request the deletion of your personal data if:
  • It is no longer necessary for the purposes outlined above.
  • You withdraw your consent for processing (if applicable).
  • The data has been unlawfully processed.
  • We are legally obligated to delete the data under EU or Polish law.
  • The data was collected from a minor under 18 through an online service.
  1. Restriction of Processing: You can request restricted processing in the following cases:
  • You contest the accuracy of your data (restricted until verification).
  • The processing is unlawful, but you prefer restricted use over deletion.
  • We no longer need the data, but you require it for legal claims.
  • You object to processing (pending determination of whether our legitimate grounds override yours).
  1. Data Portability: You have a right to receive your data in a structured, machine-readable format or have it transmitted to another administrator, where technically feasible.
  2. Objection to Processing for Marketing: If your data is processed for direct marketing, you may object at any time. Upon objection, we will immediately cease processing your data for this purpose.
